Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and Moruk, LLC regarding your use of our iOS application. By downloading, installing, accessing, or using our app, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree to these terms, you must not use our app.

Eligibility and Account Requirements

You must be at least 13 years old to use our app. If you are under 18, you represent that you have your parent's or guardian's permission to use the app. Our app does not require account creation and works without personal registration, ensuring privacy and ease of use.

Description of Service

Our iOS application provides productivity and workflow enhancement tools designed to improve your mobile experience. The app is distributed through the Apple App Store and is compatible with iOS devices running iOS 15.0 or later. Features and functionality may vary based on device capabilities and iOS version.

License Grant and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our app on your personal iOS devices. You may not:

Your privacy is fundamental to our service. Our Privacy Policy, incorporated by reference into these Terms, explains how we collect, use, and protect your information. We implement privacy-by-design principles and collect only anonymous analytics data necessary for app functionality and improvement.

App Updates and Modifications

We may periodically release updates to improve functionality, add features, fix bugs, or enhance security. While most updates are optional, some updates may be required for continued app functionality or security. We reserve the right to modify or discontinue features with reasonable advance notice.

Third-Party Services and Content

App Store Compliance

Your use of our app is subject to Apple's App Store Terms of Service and Usage Rules. In case of conflict between these Terms and Apple's terms, Apple's terms govern regarding App Store-related matters.

Disclaimers and Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR APP IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability and fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness
• Warranties that the app will be error-free or uninterrupted
• Warranties regarding security or absence of viruses
• Any warranties arising from course of dealing or usage of trade

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MORUK, LLC SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from third-party conduct or content
• Any damages exceeding the amount you paid for the app (if any) in the past 12 months

Indemnification

You agree to defend, indemnify, and hold harmless Moruk, LLC and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including attorney fees) arising from your use of the app or violation of these Terms.

Termination

You may terminate your use of the app at any time by deleting it from your devices. We may suspend or terminate your access to the app if you violate these Terms. Upon termination, your license to use the app immediately ceases.

Dispute Resolution

Any disputes arising from these Terms or your use of the app will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits or class-wide arbitration.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any legal proceedings must be brought in the federal or state courts located in Wyoming.

Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision does not constitute a waiver of such right or provision.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Moruk, LLC regarding the app and supersede all prior agreements and understandings.

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the app, our website, or other reasonable means. Continued use of the app after changes constitutes acceptance of the modified Terms.
